Employees whose services are no longer required can be made redundant, but great care is needed to avoid disputes and claims.

Employers should select candidates for redundancy on fair objective grounds and should not use redundancy as a short cut for dismissing employees who are under performing or misbehaving.

They should give advance notice of the reasons for redundancies, hold a consultation meeting before taking any final decisions, allow employees a right of appeal and look for suitable positions for employees elsewhere in the business.

Employees who are disabled or on maternity leave enjoy special protection.

Employees with two years' plus service are entitled to redundancy pay and we regularly advise those facing redundancy who are unsure of their rights.
